FOREIGN AGENT´S CONTRACT
Between INLAND PROPERTIES S.C. , with N.I.F. G-92343656, located at Avda. Constitución, nº3, Local Bajo-C, 29500 , Alora, Málaga, SPAIN, and ....., located at...............
This contract is set up to regulate the relation between INLAND PROPERTIES S.C. , hereafter called “The Real Estate”, and ...................................................................., hereafter called “The Agent”. It is ruled by the following terms:
REGISTRATION OF PROSPECTIVE CLIENT
The Agent will register the prospective client with The Real Estate with the following procedure: The Agent will send BY FAX the details of the prospective client, details of arrival in Spain, properties that he would be interested in, and any other information that would be of use by The Real Estate. An authorised representative of the Real Estate would sign this fax, and send it back to The Agent. With this, the prospective client is registered with The Agent, and any property that is sold to the client will be liable for the 50% of the comission for The Agent.
COMISSION
(AVAILABLE INFO ONLY ON REQUEST).
FIRST
Our obligation to you
The Real Estate will offer to The Agent all the infomation about properties for sale and rent in the region covered by The Real Estate. This information will include descriptions, locations, pictures, and legal backgrounds of the properties. This information will be given in good faith , and will have been provided by the owner of the property in first instance.
The Real Estate is not responsible for any miss information or miss interpretation of the information provided by the owner. The Real Estate acts as a mere intermediate between the owner/seller, and the buyer. The Real Estate will continuosly inform The Agent about the state of the purchase, informing him of the dates of signing of the deposit agreement, and the final purchase agreement, as well as the date of payment of the comission.
SECOND
All material on the web site is copyrighted. Unless it is specifically stated that particular material is available for general use then it should not be copied or re-used without express permission of The Real Estate.
The Real Estate reserves the right to gather information relating to site usage. Any information gathered is primarily for internal use to allow us to refine and improve our service to our customers.
THIRD
Our Commitment to Data Protection .At The Real Estate we are committed to safeguarding any personal information held within our database. We shall take every step necessary to protect personal data and information contained within our website as well as undertake to comply with United Kingdom or European applicable Data Protection legislation currently in existence.
3.1-Other than as required by law, The Real Estate will not disclose any personal data to any third party without express permission.
FOURTH
4.1-The Real Estate will use reasonable methods to maintain its website in optimum operating conditions and error free. As we cannot guarantee that this will always be the case, we do not accept responsibility for any defects that may exist, or for any costs, loss of profits, loss of data, or consequential losses arising from your use of, or inability to access The Real Estate´s website.
4.2-The Real Estate´s website is provided without any warranties or guarantees unless specifically stated.
4.3-Your relationship with, and interest in promotions, services, or merchants found on or via The Real Estate´s website, unless explicitly stated by us, are solely between you and the person with whom you are dealing. Should any dispute arise between you, The Real Estate will do its best to assist you in solving the situation, but we will not be responsible for any losses or damages that may arise from any such dealings.
4.4-The Real Estate may provide links to other web sites or resources. We are unable to accept responsibility for these; neither can we be deemed to have endorsed their content.
Teh Real Estate reserves the right to suspend, restrict, or terminate our website service without offering a reason.
4.5-In order to maintain our integrity, The Real Estate reserves the right to forward contact details to the Police or other regulatory authority when requested to do so; we may also forward contact details where a complaint arises concerning your use of our website where that use is deemed by us to be inconsistent with these user conditions.
FIFTH
Your Obligation to Us.
5.1- You agree that you will only use The Real Estate´s website in a manner that is consistent with these user conditions and in such a way as to ensure compliance with all applicable laws and regulations. In particular, you will not use The Real Estate´s web site to transmit or post any material which may be considered as defamatory, offensive, or of an obscene or menacing character, or which may, in our opinion, cause annoyance, inconvenience or anxiety to any person.
5.2-To the extent to which your use (or the use by any person who may be authorised by you or for whom you are responsible - for example, as the parent or guardian of a child-) causes loss or damage to any person, you agree to indemnify The Real Estate immediately on demand in relation to any such losses or damages attributable to The Real Estate, including, where necessary, any legal, administrative or technical charges that may arise from such use.
5.3-You agree not to use The Real Inland Properties website in such a way that may cause the whole or part of Inland Properties services to be interrupted, damaged, rendered less efficient or is in any way impaired.
